The Buying Process in Portugal

2. Making an Offer

Once you’ve found your dream home, we’ll go through all the details together and then formally present your offer to the seller in writing.

3. Promissory Contract (CPCV)

When an offer is negotiated and accepted (sometimes subject to a survey), LwL Properties prepares a Memorandum of Sale and sends it to both parties’ lawyers/solicitors.

The vendor’s lawyer provides all property documentation to the buyer’s lawyer.

A Promissory Contract is then drawn up and signed by both sides.

A deposit is paid, and the contract becomes legally binding.

4. Due Diligence

The buyer’s lawyer carefully checks all documentation, licences, and legal matters — including confirming the property is free of outstanding debts or charges.

5. Final Deed (Escritura)

The deed is the official transfer of ownership from seller to buyer, and the signing date is set out in the CPCV.

On the day of signing at the notary, the balance is paid, and the property becomes legally yours.

If either party cannot attend in person, they may grant power of attorney to their lawyer to sign on their behalf.

Additional Costs to Consider

When buying a property in Portugal, it’s important to budget for the following:

  • Legal Fees – Usually around 1% of the purchase price, depending on your lawyer.
  • Taxes & Fees – Property transfer tax (IMT), stamp duty, and notary fees typically amount to around 7% of the purchase price.
  • Property Survey – Optional but recommended if you would like an independent assessment of the property’s condition.

After completion, your lawyer will:

  • Register the new ownership with the Land Registry.
  • Transfer the utility bills into your name.
