Checking Your Property Documentation

Before your property can be marketed, it’s essential that all the legal documents are correct and in order. As your real estate agent, we will review these with you and your legal representative to ensure everything is ready for a smooth sale.

If you have made any changes to the property, have any disputes with neighbours, or are aware of any issues, please let us know in advance. This allows us to be fully informed before showing your property to potential buyers.

Documents usually required to sell a property in Portugal include:

  • Energy Certificate (Certificado Energético)
  • Habitation Licence (Licença de Utilização)
  • Land Registry Document (Registo Predial)
  • Tax Document (Caderneta Predial)
  • Technical Description (Ficha Técnica) – if built after 2004

6. Receiving Offers

7. Promissory Contract (CPCV)

Once an offer is agreed, both buyer and seller sign a legally binding contract, and the buyer pays a deposit.

8. Final Deed (Escritura)

At the notary, the final deed is signed and the balance is paid, officially transferring ownership to the buyer. If you cannot attend, you can grant power of attorney to your lawyer to sign on your behalf.

Costs to Consider When Selling

  • Legal Fees – Your lawyer will handle the legal side of the sale.
  • Energy Certificate – Required before marketing your property.
  • Capital Gains Tax – If applicable, depending on your situation. We recommend discussing this with your lawyer or tax advisor.

Final Steps – After Sale

Once your property is sold, your lawyer will:

  • Ensure the buyer is registered with the Land Registry.
  • Confirm utilities are transferred to the new owner.
